Is It Legal to Play Online Slots in Massachusetts?

Massachusetts Slot Machine Laws

The state laws governing slot machines in Massachusetts are similar to those in many other states.

What Massachusetts lawmakers prefer to do is issue a blanket ban on owning or using slot machines of any kind, then carve out exceptions to the law as they deem necessary. In other words, the default position of the law is that slot gambling is illegal, but there are some limited exceptions.

In Section 5A of Massachusetts general laws’ Part IV, Title I, slot machines are explicitly illegal according to the following:

“Whoever manufactures, transports sells, offers for sale, stores, displays, repairs, reconditions, possesses or uses any gambling device or parts for use therein shall be punished by a fine of not more than five thousand dollars.”

The only exception to this blanket ban is for antique slot machines. Anyone who can prove their machine is more than 30 years old can use the age of the machine as a defense against prosecution under this statute. Aside from this carve-out, slots are illegal in Massachusetts.

From this position, lawmakers wrote the Expanded Gaming Act in 2011 to create exceptions for the casinos that the new law allowed. The law divided Massachusetts into three regions and allowed each region to place a single resort casino inside one of its designated counties. Each casino could then offer full Class III gambling, including as many slot machines as could reasonably fit on the premises.

In addition, the law permitted a slots casino to offer slots play and electronic table games. This Class II casino could be located anywhere in the state rather than being limited to a single area.

So far, resort casinos have opened in the western (Region B) and central (Region A) sections of the state. MGM Springfield in Springfield and Encore Boston Harbor in Everett each offer thousands of slot machines. Additionally, the Plainridge Park Casino in Plainville is the slots casino mentioned above, and there are plenty of slots options there, too.

Massachusetts may not be finished adding slots locations, either. A casino may still open in Region C. However, there are legal and logistical issues that have caused ongoing delays in the southeastern portion of Massachusetts.
